JAIPUR: Rajasthan High Court on Wednesday directed the police department to provide with reports in writing of physical examination of candidates appearing for various posts in the department. The court directed the DGP and the secretary, home, to incorporate this condition in standing order for recruitment within two months.
Justice Manish Bhandari gave the order after the police department denied a candidate Naresh Bairwa for recruitment of constables in 2013 on the ground that his height is less than the required height of 168 cm but later on it was found wrong as his height was found to be more than the required on independent verification after he challenged his rejection in the court.
The court today directed that the candidate's case for appointment be considered provided he fulfils the other eligibility criteria and imposed a fee of Rs 5,000 on the police department.
The court said after undertaking physical examination of candidates, they should provide a copy of the report so that any candidate remains aggrieved by the measurement may file an appeal in the department itself. In the appeal, the measurement of height or chest should be made independently and therein the earlier measurement should not be supplied to the agency conducting the retest as was done in the present case. In the present case, the subsequent measurement by the medical board of the SMS hospital on the court orders had just endorsed the earlier measurement done by the police.
The court also took suo motto cognizance against the medial board which endorsed the height of the petitioner as was measured by the police on court orders and connived with Dr RK Punia, medical jurist of SMS hospital.
The court issued show cause notices to the medical board comprising Dr RK Verma, associate Prof of forensic department, Dr Vishal Gupta, associate Prof of medicine department, SMS Hospital, Dr Mahesh Meena, associate Prof of RRC department, besides Dr RK Punia.
